Do I Qualify for Innocent Spouse Relief?

Serving Clients Throughout Minnesota and Western Wisconsin

Married people who are being held liable for tax liabilities because of their spouses’ actions may request relief from the liability under IRC § 6015, which states:

‘(if) there is an understatement of tax attributable to erroneous items of one individual filing the joint return; the other individual filing the joint return establishes that in signing the return he or she did not know, and had no reason to know, that there was such understatement; taking into account all the facts and circumstances, it is inequitable to hold the other individual (spouse) liable for the deficiency in tax for such taxable year attributable to such understatement.’

Call to Discuss Separation of Liability Relief for Taxes Owed

If you are a resident of Minnesota or Western Wisconsin, and have been notified by the IRS of a tax liability resulting from your spouse’s underreporting or underpayment of federal taxes, talk to an attorney at Pridgeon & Zoss, PLLC. The law recognizes that wives or husbands may not always be fully aware of their spouses’ financial affairs and tax reporting practices. However, the IRS will not grant innocent spouse relief without a formal request for such relief.

“If you are being held liable for taxes owed because of your spouse’s errors or willful neglect of tax laws, we can help you file a request for relief that may eliminate or reduce your liability. If you are facing divorce or already divorced and your settlement includes debt owed for past tax liabilities, the Innocent Spouse Relief option may provide relief.” – Attorneys Mark Pridgeon and Dave Zoss

Our attorneys have more than 35 years of tax law and accountancy experience. We have an in-depth understanding of the conditions under which the IRS will approve of relief from liability, based on the tax code. We can also help you pursue other options to reduce or relieve yourself from liability for uncollected taxes, including:

  • Tax appeals and tax litigation
  • Strategies to have tax liabilities assigned as Currently Not Collectible
  • Bankruptcy options
  • Abatement of penalties, interest fees and fines
  • Offers in compromise and installment agreements
